Terms of Service

Welcome to Pappu, a personality-driven Hinglish Discord bot operated as an independent project by Pratyush Kumar (the "Developer", "we", "us", or "our"). These Terms of Service (the "Terms") govern your access to and use of the Pappu bot, its associated commands, invite links, partner server, and any related web properties (collectively, the "Service"). By adding Pappu to a Discord server, interacting with Pappu, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Pappu is provided free of charge for personal, community, and entertainment use. The Service is intentionally casual, sarcastic, and Hinglish-first. It is not intended as, and must not be relied upon as, professional advice of any kind.

1. Eligibility and Acceptance

You must be at least thirteen (13) years old, and old enough to have a Discord account under Discord's own Terms of Service, to use Pappu. Server owners and administrators who invite Pappu into a Discord server represent that they have the authority to do so on behalf of that server and its members, and that they accept these Terms on behalf of the server's use of the bot. Individual members who interact with Pappu accept these Terms with respect to their own interactions.

If you are using the Service on behalf of an organization, community, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" includes both you and that entity.

2. The Service

Pappu is a Discord bot that responds to prefix-based commands and mentions in text channels. Its core behavior includes:

• Reading messages in channels where it has been granted access, in order to respond to mentions or commands.
• Generating conversational replies in Hinglish using third-party large-language-model providers (currently including, but not limited to, Google Gemini).
• Retaining short-term session context per channel for a limited time in order to produce more coherent replies.
• Allowing server administrators to configure a custom per-guild personality prompt within defined limits.

The exact command set, personality tuning, provider selection, latency, and availability of Pappu may change at any time without notice as the Service evolves.

3. Acceptable Use

You agree that you will not, and will not permit any member of your server to:

• Abuse, spam, flood, brute-force, or otherwise stress the Service, whether through automated tools, macros, alt accounts, or repeated invocations designed to inflate usage.
• Attempt to bypass any rate limit, cooldown, allow-list, block-list, or moderation guardrail built into Pappu.
• Use Pappu to generate, distribute, or facilitate content that is illegal in your jurisdiction or in the jurisdiction of the Developer, including content that sexualizes minors, promotes real-world violence against identifiable people or groups, or infringes third-party intellectual property.
• Use Pappu to harass, dox, impersonate, defame, or threaten any individual or group.
• Use Pappu to exfiltrate credentials, generate malware, plan network intrusions, or facilitate any activity that would breach Discord's Terms of Service or Community Guidelines.
• Attempt to reverse-engineer, decompile, scrape, or otherwise extract the underlying model prompts, private configuration, or proprietary logic of the Service, except to the extent such restriction is prohibited by applicable law.
• Resell, sublicense, or offer paid access to Pappu, or present Pappu as your own product.

You are responsible for the content you and your community members submit to Pappu and for ensuring that use of the Service in your server complies with Discord's rules and any applicable law.

4. Server-Level Responsibilities

A Discord server that invites Pappu is considered the "Host Server". The Host Server's owners and administrators are responsible for:

• Configuring the channels in which Pappu is permitted to operate.
• Setting an appropriate custom personality prompt (if used) that does not instruct Pappu to violate these Terms.
• Moderating the human members of the server, including taking action against members who attempt to weaponize Pappu against other users.
• Ensuring that use of Pappu in the Host Server complies with local law, including but not limited to age-of-access laws applicable to your community.

We may eliminate server who break our ToS. Where a Host Server persistently permits, encourages, or itself directs behavior that violates these Terms, we may permanently remove Pappu from that server, revoke its invite, and refuse to reinstate the bot in that server or in successor servers operated by the same administrators.

5. Enforcement, Rate Limits, and Fair Use

The Service is offered at zero cost and depends on shared, finite compute and third-party API quotas. To keep Pappu usable for everyone, we operate the Service on a fair-use basis and reserve the right to enforce it at our discretion.

We may limit usage of a server or member if we notice spam behaviour or violation of Terms of Service. Enforcement actions we may take include, without limitation:

• Silently rate-limiting a member, channel, or entire Host Server.
• Temporarily or permanently disabling one or more commands for a member, channel, or server.
• Ignoring messages that appear to be scripted, automated, or otherwise abusive.
• Removing Pappu from a Host Server, with or without prior notice.
• Blocking a Discord user or server from ever re-inviting or interacting with Pappu.

We are not obligated to provide advance warning, an appeal process, or a written explanation for any enforcement action, although we may do so where practical and appropriate.

6. AI-Generated Content Disclaimer

Pappu's replies are produced by third-party large-language models and, by their nature, may be:

• Incorrect, out of date, hallucinated, contradictory, or nonsensical.
• Sarcastic, chaotic, teasing, or otherwise in-character with Pappu's personality.
• Reflective of biases present in the underlying training data of the model provider.

You must not rely on Pappu for medical, legal, financial, safety, mental-health, or other consequential decisions. Anything Pappu says is for entertainment and community interaction only. Where Pappu's output could reasonably be mistaken for authoritative information, you are responsible for verifying it independently before acting on it.

7. Third-Party Services

Pappu depends on third-party services that are outside our control, including the Discord platform and one or more AI model providers. Your use of Pappu is also subject to the terms and privacy practices of those providers as they apply to their portions of the Service. We are not responsible for outages, model changes, quota reductions, safety-filter changes, or policy decisions made by those third parties.

8. Intellectual Property

The Pappu name, mascot artwork, personality copy, prompt design, website design system, and source-code implementation are the intellectual property of the Developer, except where third-party rights are noted. You are granted a limited, revocable, non-exclusive, non-transferable license to invoke Pappu in your Discord server strictly in accordance with these Terms.

You retain ownership of the messages you send to Pappu. By sending a message that Pappu processes, you grant us a non-exclusive, worldwide, royalty-free license to transmit, cache, and process that message for the sole purpose of operating and improving the Service, as further described in our Privacy Policy.

9. Availability and Changes to the Service

The Service is provided on a best-effort basis with no guaranteed uptime, response time, or feature stability. Pappu may go offline, restart mid-conversation, lose short-term context, drop messages during incidents, migrate providers, be redeployed with different behavior, or be discontinued entirely at any time and without notice. We may add, modify, or remove commands, personality modes, limits, or entire features at any time.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ACCURATE, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE. THE DEVELOPER'S TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED FIVE HUNDRED INDIAN RUPEES (₹500).

12. Indemnification

You agree to defend, indemnify, and hold harmless the Developer from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your violation of these Terms, (b) your misuse of the Service, or (c) content submitted to Pappu by you or by members of a Host Server you administer.

13. Termination

You may stop using the Service at any time by removing Pappu from your Discord server. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to a suspected violation of these Terms. Sections 3, 6, 8, 10, 11, 12, and 15 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the "Effective" date at the top of this page. Your continued use of the Service after any change constitutes acceptance of the revised Terms. If you do not agree with an update, your sole remedy is to stop using the Service and remove Pappu from any server you control.

15. Governing Law and Contact
